Terms of Use and Privacy Policy

1. Purpose of the service

The “AquaShot” application (the “Application”) is a tool that estimates the dehydration caused by drinking beverages. The information it provides is for guidance and educational purposes only.

2. Medical and legal disclaimer

The publisher of the Application cannot be held liable for the consequences of excessive alcohol consumption by the user. The Application does not provide medical advice, does not measure the actual blood alcohol level, and in no way validates a user's fitness to drive a vehicle. Users are solely responsible for their consumption and their decisions. The Application's calculations rest on published references, cited in the Application (“Calculations and sources” screen): they are general estimates for a healthy adult.

3. Privacy and personal data (GDPR)

We place the utmost importance on the confidentiality of your data:

• No collection: the Application requires no sign-up, no name and no email address.
• Local storage: all data about the drinks you log (alcohol and water), as well as your trophies, is stored exclusively in your own phone's local storage.
• Retention: the details of your drinks are kept for 4 weeks, then only one summary per day (water drunk, goal, share due to alcohol) is kept for 12 months for the history; after that, everything is deleted automatically. Like the data of your other apps, this data may be included in the phone backups you make yourself (for example iCloud).
• Weight: if you choose to enter it (it is optional), your weight is only used to work out your water needs. It is stored exclusively on your phone and can be changed at any time in the settings.
• Apple Health (iPhone only, optional): if you allow it, the Application reads your workouts (type, duration, energy burned) from the Health app to adjust your daily water goal, and writes to it the water you drink and the counted share of other drinks; alcohol is never written there. This data stays on your phone: it is never sent to the publisher or to any third party, is not used for advertising or marketing, and never appears in error reports. You can turn this link off in the Application's settings, and remove access at any time in the Health app.
• Android: on Android, the Application does not access any health data on the phone (neither Health Connect nor any other health service).
• No sharing: your drinks, your weight, your health data and your settings are never sent to the publisher or to any third party. Only technical error reports may be sent, as described below.
• Error reports: when the Application crashes or runs into an error, a technical report is sent to our provider Sentry (Functional Software, Inc.), on servers located in the European Union, for the sole purpose of fixing the problem. The report contains the description of the error, the version of the Application, the phone model and the version of its operating system; it may include a random technical identifier specific to the installation, which does not identify you. It contains neither your drinks, nor your weight, nor any name, email address or advertising identifier, and your IP address is not stored in it. These reports are not used for advertising or tracking, and are kept for 90 days at most.
• Notifications: reminders are local notifications, scheduled and triggered by your phone itself, without going through any server.
• Cards to share: the pictures of your trophies are created on your phone. They are only sent if you decide so, to the app you pick in the system's share menu; the Application does not send them to any server. Access to your photos is only used to save a picture there, if you ask for it.
• External links: the “Calculations and sources” screen opens pages of third-party sites (scientific publications) in your phone's built-in browser. These sites have their own privacy rules; the Application sends them no data.
• Deletion: deleting the Application from your phone permanently and immediately deletes all of your consumption data. Water already written to the Health app (iPhone) stays there: you can delete it from the Health app.

4. Governing law

These terms are governed by French law. Any dispute relating to the use of the Application shall be subject to the exclusive jurisdiction of the French courts. The French version of these terms prevails in case of discrepancy.
